The U.S. Department of Justice and the Office of Civil Rights of the Department of Education have put the word out to colleges: make sure your online materials are ADA Section 504 compliant. The implication is that enforcement will be much stricter in the future, so institutions should prepare now.https://hubs.la/Q01SS4Fb0https://hubs.la/Q01SStcy0

This lands on me as pretty remarkable - the executive branch providing an entire sector with direct guidance on how best to navigate a thorny ruling by the legislative branch. #highereducation #admissions #affirmativeaction https://lnkd.in/ed4Z5mQt

A major win for housing developments and homeowners from the US Supreme Court yesterday in the Sheetz v. County of El Dorado case. On a 9-0 unanimous decision the Supreme Court found that constitutional protections indeed do extend to impact and development fees created by elected bodies (city councils, etc) and that excessive fees can be challenged under the takings clause. There isn’t a debate that development infrastructure must be properly built and funded. But as we see too often in MN, the fees are excessive and, until yesterday, it wasn’t clear if charging excessive fees could be challenged as a regulatory taking. Another important step in the multi-dimensional effort to bring back starter homes and extend the opportunity of homeownership to all Minnesotans. From The Wall Street Journal Editorial Board:“Good news. A unanimous Supreme Court on Friday ruled (Sheetz v. County of El Dorado) that the Fifth Amendment’s Takings Clause applies to legislatures that impose excessive fees. This is an important constraint on greedy governments”#housing #homeownership #homebuilding Housing First Minnesota Nick Erickson

Interesting move by the Supreme Court on Affirmative Action today, and to be honest, personally I expected it. I did intently watch how during the past 3 or so years, schools made substantial effort —it seemed— to leave white males out of admissions. I am pro-woman, of course, but it was hard to believe and accept only women were suited to fill, in example, surgical fellowships (that’s were it became very obvious to me… to the point of bringing it up at home, even!)That said, keep in mind this legal precedent is now in place, and will be used to create much greater impact far and wide… for example in our own Construction industry :I believe this has now paved the path to equally deem illegal the M/WBE requirements currently in place for RFQs / RFPs with public and semi-public jurisdictions. We could only speculate on speed, but you better believe it is very likely to be coming.Fortunately, I personally never believed in such a label, and despite the obvious (that I am a woman myself!), when I founded Ponte Health as a service company back when, it was always with the intent to become better by means of fair, non-gendered, quality outcomes only, and not by any other way.Needless to say… interesting times ahead. It is the duty of every organization, regardless of size or function to properly accomodate every member.A six month ban does just seem high-handed, it's clearly in violation of Ontario Human Rights law. It also exposes a glaring problem of board function when voters rights are removed by a punishment without an Ontario court deciding it was the best course of action. In my opinion the ban prejudices a court and it's authority. Duty to accommodate is the standard in Ontario and it requires organizations to keep trying without becoming negative. https://lnkd.in/gcVaC_Er

Can an operator who has lost 1954 Act rights through inadvertence get a second bite of the renewal cherry under the Code? Answer, yes, apparently: a very interesting decision this, with a number of potential discussion points including- how willing, really, will the Tribunal be to police "gaming" of the system (assuming there will be any point in such gaming, which there may well not be after s61 of PSTIA 2022 is passed, making rent assessments under the code and the 1954 Act the same)-is a para 20 notice served too early if served before 3 months and 21 days from the strike-out of a 1954 Act renewal application have elapsed?-is this the final word on this whole issue?

Just yesterday, the Victorian Labor Government announced the appointment of 20 new members at the VCAT, addressing the urgent backlog of residential tenancy cases, and improving overall efficiency. As a law firm with significant experience at the VCAT, we congratulate the Government's efforts to increase access to justice for more Victorians. One key point highlighted here is the plan to completely clear the backlog by the conclusion of 2024.This action is an important contribution to the infrastructure of justice. Just as it is not enough for the government to give people cars, they must also invest in roads. It is the same story here. It is not sufficient to establish legal protections (i.e. 𝘋𝘰𝘮𝘦𝘴𝘵𝘪𝘤 𝘉𝘶𝘪𝘭𝘥𝘪𝘯𝘨 𝘊𝘰𝘯𝘵𝘳𝘢𝘤𝘵𝘴 𝘈𝘤𝘵 𝟣𝟫𝟫𝟧 (Vic) s 8) without investing in the forum (VCAT) where those protections are actually enforced.https://lnkd.in/gPm3jtX3
