Daily News Thursday Dec 9 1982 Death Bill Deferred 4 Action on BOSTON (AP) Despite expectations that raetion would come this week the Legislature has deferred action on a compromise bill restoring capital punishment in Massachusetts until Monday at the earliest Rep Paul White House chairman of Public Safety Committee said late (Wednesday that a House Senate conference com mittee had not reached agreement on a compro mise death penalty bill but he hopes to have a bill ready by Monday Senate President William Bulger had put the Senate on notice Tuesday to be prepared to debate the issue during session Both chambers have passed different versions of a death penalty statute but they must agree on a single measure before it can go to Gov Edward King White one of the House conferees said House members (of the conference committee) spent a good deal of time (Wednesday) going through a proposed of a compromise bill and it would be presented to the Senate conferees by end embodies many of the considerations in both the House and the Senate White did say that the compromise measure probably would give a condemned killer a choice in the manner of execution electrocution or lethal injection The original House bill provided for electrocu tion the Senate bill lethal injection White said no decision had yet been made on another disputed matter whether prospective Statehouse jurors in capital cases could be asked their posi tion on the death penalty and excluded from ser vice because of their answer The Senate bill included a prohibition against this line of questioning in the jury selection process No Action on Bottle Law The House meanwhile ended formal sessions this week without acting on the Senate passed bill beverages Still pending in the Senate meanwhile was a final vote on the bill repealing Sunday closing law Religious groups have mounted a last minute campaign against repeal and Gov Edward King said he is cally to the bill but he decided whether he would sign or veto it The bill needs only the final Senate vote to go to the governor House Speaker Thomas McGee announced plans for meetings Monday Tuesday and Wednes day of next week including night sessions when much of the remaining business of the 1982 Legis lature is expected to be wrapped up Session Will Dissolve McGee said he does not expect meetings the week before and after Christmas and the legisla tive session will automatically dissolve Jan 4 unless it is formally ended before then which is not expected The Legislature has occupied itself with pay raises to a great extent since the Nov 2 election granting hikes to judges statewide officeholders Dukakis Taking Vacation Before Assuming New Job BOSTON (AP) Gov elect Michael Dukakis departs on a week long lorida vacation today before returning to Massachusetts and completing the work on his return to the Statehouse Jan 6 Dukakis capped three straight days of public announcements on his plans for a second term Wednesday by outlining the work he wants his lieutenant governor John Kerry to do in the Statehouse Kerry will perform most of the same functions that Thomas HI did as lieutenant gover nor during first term supervise the Massachusetts liason office in Washington get the most federal funds available for the state and help any Bay State cities and towns with federal problems Kerry also will use his experience as a prosecutor in Middlesex County became and after Kerry defeated four rivals for the Democratic nomination as lieuten ant governor Kerry said he was of the role Dukakis had carved out state Supreme Court chief justice have passed the Massachusetts Senate as part of a salary increase package for court clerks The amended bill now returns to the House which originally passed the measure 133 6 for further action The House and Senate next meet in formal session Monday On voice votes Wednesday the Senate approved the House passed increases of about $6000 for most district court salaries estimated to cost $13 million The Senate Ways and Means Committee added an amendment to the bill which its chairman Sen Chester Atkins Concord said addressed the issue of similar salaries for the chief justice and the lower district court judges Raises for judges were already included in a package of hikes for legislators and constitutional officers passed just after the November election and effective in January The lame duck Legisla ture whose critics are charging is giving out is also moving toward $17500 raises for district attorneys in a package worth $15 million The amendment to the clerks bill calls for the Supreme Court chief justice to make $70000 instead of the new $65000 salary scheduled in January Under the new pay scale the governor will make $75000 The chief justice makes $62064 now The amendment also calls for a $67500 salary for Supreme Court associate justices up $5000 from the new January scale and about $7500 from present pay and themselves and advancing because of a recently passed bill creating 14 new judgeships Debate on the bill centered more on the timing than the need for more judges Opponents claimed that the new judgeships were being created
